Terms of Use

CommerceMakers describes Shopify and e-commerce design and development services offered by Architech NYC. The main Architech NYC website is located at https://architech.nyc.

By using the landing page or submitting an inquiry, you agree to these Terms. If you do not agree, do not use the landing page or submit information through it.

1. Landing Page Purpose

The landing page is provided for general informational and marketing purposes. It describes Architech NYC’s Shopify and e-commerce service offer, representative experience, pricing structure, process, and ways to contact or book a call with our team.

The landing page is not an online store checkout, marketplace, or self-service purchase flow for professional services.

2. No Automatic Client Relationship

Submitting a form, requesting information, booking or joining a Calendly call, or exchanging preliminary messages with Architech NYC does not create a client relationship, professional services engagement, fiduciary relationship, or obligation for either party.

Any project begins only when both parties sign a written statement of work, proposal, master services agreement, or similar written agreement.

3. Services Described

The landing page may describe Shopify and e-commerce design and development services, including strategy, UX/UI design, Shopify theme work, configuration, integrations, QA, launch support, and related consulting.

Exact deliverables, timelines, dependencies, assumptions, exclusions, acceptance process, payment terms, and post-launch support are confirmed only in the applicable written SOW or services agreement.

4. Pricing, Package Scope, and Third-Party Costs

Any price shown on the landing page applies only to the package scope described on the landing page and is subject to confirmation in writing.

The landing page itself is the public description of the package. If a separate written SOW, proposal, or services agreement is later signed, that written agreement controls over the landing page.

Unless expressly included in a written agreement, prices do not include taxes, Shopify subscription fees, Shopify app fees, payment processor fees, paid themes, hosting or third-party platform costs, product photography, copywriting, advertising spend, data migration, custom integrations, additional design concepts, ongoing maintenance, or post-launch support.

5. Client Responsibilities

Clients are responsible for timely approvals, brand assets, product information, copy, images, third-party account access, required credentials, legal/compliance content, and feedback. Delays in these inputs may affect project timing and launch readiness.

Clients are also responsible for reviewing their own website content, product claims, privacy disclosures, terms, regulatory compliance, taxes, payment processing, fulfillment, returns, and other business operations.

6. Third-Party Platforms and Services

Shopify, Shopify apps, Calendly, payment processors, analytics tools, Microsoft Clarity, email providers, CRM tools, hosting providers, and other third-party services are governed by their own terms, privacy policies, fees, and technical limitations.

Architech NYC is not responsible for third-party outages, policy changes, pricing changes, account restrictions, data practices, security incidents, or service limitations outside our control.

7. No Guaranteed Results

Architech NYC may use conversion-oriented design practices, technical best practices, and industry experience, but we do not guarantee any specific revenue, conversion rate, traffic level, search ranking, customer acquisition result, funding outcome, or business result.

Any case studies, benchmarks, third-party statistics, or examples are provided for general context and do not guarantee that a particular client will achieve the same or similar results.

8. Portfolio, Logos, Testimonials, and Case Studies

Architech NYC may use client names, logos, screenshots, testimonials, case studies, project descriptions, and portfolio examples in marketing materials, including on the landing page, unless a separate written agreement restricts that use.

Portfolio examples and case studies may reflect work delivered at handoff or during a specific project phase. Third-party or client-controlled websites may change after launch and may not reflect Architech NYC’s original work.

9. Intellectual Property

Ownership of custom project deliverables is governed by the signed SOW or services agreement. Unless otherwise agreed in writing, Architech NYC retains ownership of its pre-existing tools, reusable code, templates, frameworks, know-how, methods, processes, and general development practices.

Third-party materials, software, fonts, stock assets, Shopify themes, plugins, applications, and open-source components remain subject to their respective licenses and terms.

10. Confidentiality

Do not submit confidential, proprietary, regulated, or sensitive information through public landing-page forms unless we specifically request it and appropriate confidentiality arrangements are in place.

Confidentiality obligations, if any, are governed by a signed NDA, MSA, SOW, or other written agreement between the parties.

11. Acceptable Use

You agree not to misuse the landing page or related services. You may not:

• attempt to interfere with the landing page’s security, availability, or operation;
• submit false, misleading, unlawful, infringing, or harmful content;
• use automated scraping, harvesting, or extraction tools without permission;
• impersonate another person or misrepresent your affiliation with a company; or
• use the landing page in a way that violates applicable law or third-party rights.

12. Website Content

Landing-page content is provided “as is” for general informational purposes. We may update, remove, or change landing-page content at any time without notice.

Nothing on the landing page is legal, financial, tax, regulatory, or other professional advice for your business.

13. Disclaimers

To the fullest extent permitted by law, Architech NYC disclaims all warranties, express or implied, regarding the landing page and landing-page content, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, and accuracy.

14. Limitation of Liability

To the fullest extent permitted by law, Architech NYC will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption arising from your use of the landing page or reliance on landing-page content.

Any liability related to a signed services engagement will be governed by the applicable written agreement between the parties.

15. Links to Third-Party Sites

The landing page may link to third-party websites or services. We do not control and are not responsible for third-party content, policies, security, or practices.

16. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date shows when the Terms were most recently revised. Continued use of the landing page after updates means you accept the revised Terms.

17. Governing Law and Venue

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, unless a separate written agreement between you and Architech NYC provides otherwise.

To the extent a dispute arises from these Terms or use of the landing page and is not governed by a separate written agreement, the parties consent to the jurisdiction of the state and federal courts located in New York County, New York.
